TERMS AND CONDITIONS

 

 

 

       A. Term Definitions

  1. “Competition”:  The Competition run by the Promoters, Ryan Mclean and Katherine Jablonowska, to which these terms and conditions apply. Entrants submit their Entries through the website www.cwellyndream.com or by post to Cwellyn Cottage, Rhoslan, Criccieth LL52 0NB.

  2. “Prize”: The Prize is Cwellyn Cottage, Rhoslan, Criccieth LL52 0NB, a freehold detached stone cottage. All UK taxes including stamp duty will be covered by the promoter. The winner’s conveyance fees up to and including £1500 + VAT, will also be paid for by the Promoter. The Winner may choose their own conveyancy solicitor. The property is mortgage free, and will be furnished minus artwork and personal items. 

  3. “Promoters”: The Promoters are Mr Mclean and Ms Jablonowska of Cwellyn Cottage, Rhoslan, Criccieth LL52 0NB

  4. “Question”: The Question that each Entrant must correctly answer in order to have the opportunity to win the prize (in accordance with the Gambling Commission’s Rules and Guidelines regarding Skilled Prize Competitions). The website randomly generates a question from a selection set by the Promoters. The Promoter sets the questions and determines the correct answers. 

  5. “Entry”: The Entry is comprised of a correct answer given to the Question set by the Promoter. Entries cost £5.00 GBP each through the website or are free of charge by Post. Entries may also be referred to as “Tickets”. 

  6. “Entrant”: The Entrant is any person who enters the competition to win the prize via the website or via postal application. Businesses, corporations or limited liability partnerships are excluded from entering. Each entrant must be over the age of 18 to enter the competition.

  7. “Winner”: The Entrant that is drawn on 30th September 2020 at 12pm by an independent random number generator. The Winner must be able to confirm their identity to the satisfaction of our solicitor to begin transfer of the deeds. The promoter will cover travel costs of the winner to Cwellyn Cottage from within the UK.

  8. “Valuation”: The top market £290,000 value of Cwellyn Cottage has been determined by independent Estate Agents valuations. The Promoter does not determine or guarantee the value of the Prize. 

  9. “Opening Date”: The Competition opens on Friday 15th May 2020 at 12pm. 

  10. “Closing Date”: The Competition will close on 15th September 2020 at 12pm. The Prize will be drawn on 30th September 2020 at 12pm.

  11. “Minimum Number of Paid Entries”: 80,000. If this threshold is met, Cwellyn Cottage will be awarded as the Prize.

  12. “Donation”: Each Entrant has the option to add a £1 donation to their Entry purchase on the website. 100% of this donation will be awarded to The Children’s Society (Charity Registration No.: 221124). If the Minimum Number of Paid Entries is met, the Promoter also agrees to match this donation made by the Entrants and donate it to the charity after the competition closes.

     

      B. The Prizes

  1. The main purpose of the Competition is for one Entrant to win Cwellyn Cottage as the Main Prize. Further details regarding the Prize can be found on the Promoter’s Website.

  2. The Main Prize, Cwellyn Cottage will be awarded free of any mortgages, encumbrances and land taxes or registration fees liable in the UK, if the minimum number of tickets are sold.

  3. The Entrant acknowledges and accepts that if fewer than the minimum number of tickets are sold, the winner will be awarded an Alternative Prize, consisting of the cash equivalent of the total number of tickets sold, minus 20% administration fees, as outlined below.​​​​​​

  5. 10,000 tickets sold - £40,000 Cash Prize

  6. 20,000 tickets sold - £80,000 Cash Prize

  7. 40,000 tickets sold - £160,000 Cash Prize

  8. 60,000 tickets sold - £240,000 Cash Prize

  9. 80,000+ tickets sold - Cwellyn Cottage guaranteed to be awarded

  10. The Promoter will issue a statement on the website informing all entrants that Cwellyn Cottage is confirmed as the prize, when the minimum number of tickets has been reached.

  11. The Promoter is responsible for changing the title deeds with HM Land Registry to the Winner’s name. 

  12. Additionally, if the minimum number of paid Entries has been reached, the Promoter will announce the name of the Entrant who generated the most ticket sales through sharing their personalised URL link. This individual will be awarded a £10,000 cash prize. If the actual number of tickets sold is less than the Minimum Paid Entries required to award Cwellyn Cottage as the prize, the Promoter will not award the £10,000 cash prize.  

   

 C. The Competition

  1. The price to enter the competition is £5.00 GBP per Entry, and is payable via the Website. All payments must be made through the Promoter's chosen payment Gateways, and must adhere to the Gateways' Terms and Conditions. Alternatively Postal Entries can be made free of charge, as outlined in the Terms and Conditions. 

  2. Valid Entries must be submitted in English and include;

  3. ) A correctly answered question 

  4. ) The Entrant’s contact information

  5. The Entrant acknowledges that in answering the Question, they are demonstrating a level of skill and judgement in determining the correct answer, in accordance with the Gambling Commission Guidelines on Skilled Prize Competitions. The Entrant acknowledges therefore that this is not a lottery.

  6. Entries made via www.cwellyndream.com; Upon submitting an answer to the question and providing contact information, the Entrant will provide payment information (for example credit or debit card information), and payment will be taken from the Entrant for the number of Entries they have selected to purchase. Payment will be electronically approved and the Entrant will be sent an electronic receipt via email.

  7. The Entrant acknowledges that Entries, purchased or sent by post, are only submitted to the final prize draw if they have correctly answered the question set by the Promoter, in accordance with the Gambling Commission Guidelines on Skilled Prize Competitions. The Promoter’s decision is final.

  8. After payment has been submitted and confirmed via the Website, each Entrant will be provided with a Unique Reference Link (URL), that they can share online to earn additional free Entries. Free entries are earned by generating ticket sales among their social network. The Entrant can earn 1 free Entry for every 5 sold through their Unique Reference Link (URL). The Entrant can track their accumulated free Entries through their private account on the Competition website. 

  9. The Competition will close on the Closing Date.

  10. The Winner will be decided within 14 days of the closing date of the Competition.

  11. After the Competition has closed, the Promoter will assign a unique reference number to each individual Entry that has correctly answered the "skill testing question", provided all required contact information and complied with all other Terms and Conditions. 

  12. The Promoter will draw the winner at random using an online number generator, from the Entries that have been assigned a unique reference number. None of the Entrants' personal information will be associated with deciding the Winner.  The draw will take place under the supervision of a solicitor and chosen members of the press.  

  13. Once the Winner has been chosen, the Promoter’s decision is final and no further correspondence will be engaged in regarding the result of the Competition.

  14. The Promoter will attempt to contact the Winner by phone and email. If after 28 days the Promoter has been unable to make contact, or the contact details provided are incorrect, the Winner forfeits their right to the Prize and the ability to be included in any further draw. The Promoter will then undertake a new draw to determine a new Winner. This process will continue until a Winner has been contacted and successfully confirmed their identity with the Promoter.

  15. The Winner agrees to provide a copy of their passport or driving licence (or equivalent ID) to confirm their identity. 

  16. The Winner may be required to travel to the Promoter’s solicitors offices within 28 days of accepting the Prize in order to sign a transfer deed to transfer the property into the Winner’s name.

  17. If the minimum number of paid Entries has been reached, the Promoter will announce the name of the Entrant who generated the most ticket sales through sharing their personalised URL link. This individual will be awarded a £10,000 cash prize. If the actual number of tickets sold is less than the Minimum Paid Entries required to award Cwellyn Cottage as the prize, the Promoter will not award the £10,000 cash prize.  

     D. General Competition Terms

  1. By entering the Competition, the Entrant understands these Terms and Conditions as outlined below and agrees to be bound by them.

  2. The Competition is run by the Promoters.

  3. The Entrant agrees to provide their contact details as required by the Promote. The Promoter agrees to comply with the privacy policy and use these details only for the following purposes:

  4. ) To notify Entrants of any changes or developments in the Competition

  5. ) To inform the Winner they have won the Prize

  6. ) To announce the Winner on the website and corresponding social media outlets 

  7. The Entrant is solely responsible for providing their correct contact information to the Promoter. The Promoter is not liable for any inability to contact the Entrant due to inaccurate contact information provided by the Entrant or otherwise. If the Promoter is unable to contact the Winner of the Competition due to inaccurate contact information, the Winner will forfeit their right to the Prize and the Promoter will choose a new Winner. 

  8. The Entrant agrees to allow the Promoter to store and use their contact information and any other personal data collected in accordance with the Data Protection Act 1998, for the purpose of running the Website and Competition.

  9. The Promoter has no access to the Entrant’s password.

  10. The Entrant agrees to allow the Promoter to share their contact information and personal data provided to relevant third parties for the purpose of preventing fraud, money laundering, or any other legal or regulatory reasons. 

  11. The Competition is open to anyone aged 18 or over, excluding the Promoters, their family members, advisors, employees or anyone associated with the running of the Website and or Competition in any way, shape or form.

  12. Valid Entries must be submitted via the Website www.cwellyndream.com or by post to Cwellyn, Rhoslan, Criccieth LL52 0NB and contain the correct answer to the "Question", the entrant’s name, date of birth, telephone number and email address.

  13. All postal entries are free of charge, and only accepted from within the United Kingdom. Each Postal Entry must be submitted on an individual postcard and sent with a first-class stamp. Each postcard must contain the Entrant's name, date of birth, telephone number and email address, and the correct answer to the question. Entry postcards sent in envelopes will not be accepted and the Entries will be void. 

  14. On entering the Competition, the Entrant acknowledges that payment of £5.00 GBP per Entry (or submitting a free entry) and a correctly answered question does not in any way guarantee they will win the Prize.

  15. The Price of £5.00 GBP per Entry is set by the Promoter and all payments must be made in Pound Sterling. 

  16. Each Entry to the Competition along with the correct answer to the Question entitles the Entrant to one chance to win the prize; for example, 20 Entries with the correct answer gives the Entrant 20 chances to win the Prize.

  17. Only completed Entries made in accordance to these Terms and Conditions will be admitted to the final prize draw. Please see www.cwellyndream.com  for more details.

  18. The Promoter agrees to ensure that all Entries, paid or free, are treated equally by the Promoter, as long as all other conditions are met.

  19. The Promoter will not be held liable if the Entrant enters the Competition unlawfully. The Entrant acknowledges they are solely responsible for ensuring they do not contravene any law in their country of residence by entering the Competition. 

  20. The Entrant acknowledges the Promoter’s right to disqualify, entirely at their own discretion, any Entrant or Entry, in the event that the Terms and Conditions are breached, including but not limited to inaccurate or untrue information being submitted.  

  21. All Entries automatically become property of the Promoter upon receipt and will not be returned.

  22. There is no limit to the number of Entries that can be made by any one person via the Website, but all Entries but adhere to the aforementioned Terms and Conditions. 

  23. The Promoter is not responsible or liable for the valuation or condition of the Prize. 

  24. The Promoter reserves the right to amend these Terms and Conditions at any time.  All competition participants shall be notified of any changes and will have a period of 14 days to object to any amendments or request a full refund of the ticket.

  25. If the Winner is or becomes ineligible to win the prize, fails to comply with the terms and conditions or cannot proceed with completion on the house within 3 calendar months from the date of the draw, an alternate winner will be chosen in the same way that the winner was selected.

  26. The Promoters and Entrants recognise that the conditions under which the Competition is run are governed by English Law, and that in the event of any dispute, the County and High Courts have sole jurisdiction.

     E.  Closing The Competition

  1. The Competition ends on the Closing Date, 15th September 2020, at Midnight. 

  2. The Promoter reserves the right to extend the Competition by up to 28 Days beyond the stipulated Closing Date. All competition participants shall be notified of any changes to the Closing Date and will have a period of 14 days to object to any amendments or request a full refund of any tickets purchased.

  3. If the Minimum number of Paid Entries has been reached, the Winner will be chosen as outlined in these Terms and Cwellyn Cottage will be awarded as the Prize. 

  4. If the Minimum Number of Paid Entries has not been reached by the Closing Date, then an “Alternative Prize” will be awarded in place of the Prize.

  5. The “Alternative Prize” will consist of a cash prize amounting to the total money generated by Paid Entries, minus administrative costs retained by the Promoters (capped at a maximum of 20% of the total sales). 

  6. The Promoters will choose the Winner of the “Alternative Prize” in the same manner stipulated as for the Prize.

     F.  Other

  1. In the case of a force majeure event intervening in the competition, the competition may close and the prize be awarded or refunds provided to those who have paid to enter, at the discretion of the Promoter.

  2. The Prize is awarded in its current state. The Promoter provides no guarantee or Warranty regarding the valuation or condition of the Prize. The Winner of the Prize should undertake their own enquiries regarding the property; including commissioning their own Chartered Building Survey should they deem it necessary. The Entrant acknowledges they are solely responsible for satisfying themselves regarding the condition and accuracy of the Prize description, and commission their own reports and surveys.  

  3. The Promoter is not liable for any taxes, fees or payments due of any kind outside the UK, that the Winner may be liable to pay on receiving the Prize.

  4. Entrants agree that the usual requirements under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 for goods and services ordered on line to be supplied within 30 days will not apply to this Competition.

  5. The Promoter does not accept liability or responsibility in the event that Website Entries are not received due to failed computer communications or loss through use of the Promoter’s Website, including merchant transaction malfunctions, internet traffic, server faults, software or hardware malfunctions or any other reason. The Promoter does not accept responsibility for any Postal Entries not received due to delivery error or failure.

  6. The Promoters, employees and agents will not be liable for any loss, economic or otherwise, suffered to or sustained by any person or property as a result of any act or omission, during or following the distribution of the Prize to the Winner.

  7. Any Entry can be declared void, without refund if the Entrant:

  8. )engages in any kind of fraudulent activity to enter the Competition, including but not limited to fraudulently misrepresenting themselves or the Promoter

  9. )hacks or interferes with the functioning or coding of the website

  10. None of the Terms and Conditions outlined above constitute a contract, joint venture or agreement between the Promoter and Entrant.

  11. All Entrants and Entries will be treated equally, as long as all conditions are met.

  12. All Entrants should retain a copy of these Terms and Conditions for their records.
